ABSTRACT SRI RISKI YANTI, 2020 Wardah S.H., M.H., LL.M. A canned fish products tainted with worms are found in Indonesia on March 2018. The products was indicated did not meet the food safety standard whereas Article 71 (1) of the Law No. 18 of 2012 on Food has guaranteed the implementation of food safety, which is safe from biological, chemical, and other objects contamination. Indonesia as the World Trade Organization member needs to implement the Sanitary and Phytosanitary (SPS) Agreement properly through the national regulation to protect public health. This study aims to find out food safety regulations for imported food in Indonesia, especially in the case of the canned fish tainted with worms, to know the role of the Food and Drug Monitoring Agency (BPOM) as an official government concern about the implementations and the challenges face by Indonesian on imported canned food. This research is in the form of normative legal research stipulate a systematic exposition by comparing the existing rules regarding on food safety and previous related cases. The results showed food safety regulation in Indonesia is sufficient, but the role of the BPOM still lack of supervising. On the other hand, the challanges found because of some regulations did not cover specific things on the limit of expired foods and broken canned packages. The role of the consumer and producer still lack on their duties and obligations regarding illegal marketing distribution. The strengthen function and supervision of the BPOM is needed with creating a new special division to focus on supervision of imported food. Public awareness toward the challenges is important, by revising Law No. 8 of 1999 on Consumer Protection and Government Regulation No.86 of 2019 on Safety, Quality and Food Nutrient by adding the article about limitation of time for recall goods before the expiration date. Revising the Regulation of the Head of BPOM No. 22 of 2017 on Food Recall from Distribution by adding the article on the broken food packaging. On illegal marketing distribution, the society needs to be carefull in purchasing the goods. Thus, the implementation of food safety can be achieved by all stakeholders.
