PENGAWASAN DAN PEMBINAAN MAJELIS PENGAWAS DAERAH TERHADAP NOTARIS YANG MELAKUKAN PELANGGARAN Irma MuliaFitri Ilyas Ismail** Suhaimi*** ABSTRAK Majelis Pengawasan berjumlah 9 (sembilan) orang terdiri dari unsur pemerintah sebanyak 3 (tiga) orang, Organisasi Notaris sebanyak 3 (tiga) orang dan ahli atau akedemisi sebanyak 3 (tiga). Pengawas terhadap Notari smeliputi perilaku Notaris yang diatur dalam Pasal 67 Undang-Undang Nomor 30 Tahun 2004 dengan perubahan Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris. Berdasarkan aturan Pasal 70 (a) Tentang Majelis Pengawasan Daerah (MPD) berwenang menyelenggarakan sidang untuk memeriksa adanya dugaan pelanggaran. Berdasarkan hasil pemeriksaan Majelis Pengawas Daerah Kabupaten Aceh Timur, Notaris Awaludin telah dijatuhin Hukuman Pidana, seharusnya Notaris Awaluddin menggusulkan permohonan Protokol Notaris Pengganti kepada Majelis Pengawas Daerah Kabupaten Aceh Timur. Selain itu Majelis Pengawas Wilyah harus memperhatikan Pasal 13 Undang-Undang Nomor 30 Tahun 2004 dengan Perubahan Undang-Undang Nomor 2 Tahun 2014 Tentang Jabatan Notaris. Notaris dapat diberhentikan dengan tidak Horma toleh Menteri karena dijatuhi Pidana Penjara berdasarkan putusan pengadilan yang telahmemperoleh kekuatan hukum tetap karena melakukan pidana penjara 5 (lima) tahun atau lebih. Tujuan dalam penelitian ini untuk menjelaskan tentang pelaksanaan dan pembinaan Majelis Pengawas Daerah terhadap Notaris yang melakukan Pelanggaran, serta untuk menjelaskan kendala yang dihadapi Majelis Pengawas Daerah dalam melakukan pengawasan dan pembinaan untuk menjelaskan upaya yang dilakukan dalam mengatasi terjadinya hambatan dalam pembinaan Majelis Pengawas Daerah untuk menjelaskan akibat hukum yang diberikan oleh Majelis Pengawas Daerah terhadap Notaris. Jenis Penelitian yang digunakan adalah penelitian hukum empiris (yuridis empiris), yaitu Penelitian yang digunakan untuk menganalisis hukum yang dlihat sebagai perilaku masyarakat yang berpola dalam kehidupan masyarakat yang selalu berinteraksi dan berhubungan dalam aspek kemasyarakatan, jenis Pendekatan penelitian lapanganakan berlakunya hukum positif mengenai Pengawas dan pembinaan Majelis Pengawas Daerah terhadap Notaris yang melakukan pelanggaran. Penelitian bersifat deskriftif analisi yang bersifat kualitatif untuk mengambarkan, menelah dan menjelaskan serta menganalisa perundang-undangan yang berlaku. Berdasarkan hasil Penelitian, pelaksanaan yang dilakukan Majelis Pengawasan Daerah untuk saat ini,Provinsi Aceh membentuk 3 MajelisPengawas Daerah yaituMajelisPengawas Daerah Banda Aceh, MajelisPengawas Daerah Aceh Utara danMajelisPengawasan Daerah Aceh Timur. Kendala Yang dihadapinMajelis Daerah dalam melakukan pengawasan dan pembinaan adalah waktu yang sulit ditentukan dalam pengujungan dikantor Notaris dimana Setiap Majelis Pengawas Mempunyai waktu yang berbeda, Upaya yang dilakukan Majelis Pengawasan Majelis Pengawas melakukan pembinaan dari Majelis Pengawas Pusat keMajelis Pengawas Wilayah dari Majelis Pengawas Wilayah melakukan Pengawasan dan Pembinaan Kabupaten Kota.Akibat Hukum yang timbul terhadap tidak terlaksanakannya Pengawasan oleh Majelis Pengawas yang berdampak kepada masyarakat yang membutuhkan Notaris dalam pembuatan akta. Disarankan Majelis Pengawas Notaris haruslah mengadakan pembinaan secara teratur setiap tahunnya yang bertujuan agar para Notaris tidak ada yang melakukan pelanggaran. Kata Kunci: Pengawasan, Majelis Pengawasan Daerah dan Notaris SUPERVISION AND ADVISING CONDUCTED BY REGIONAL SUPERVISORY COUNCIL TO NOTARIES COMITING VIOLATION Irma Mulia Fitri Ilyas Ismail** Suhaimi*** ABSTRACT Supevison council which consists of 9 members, 3 are from the government agency, 3 are from the notary agency, and 3 other are from experts or academics.The supervision includes the notaries’ attitude and how the notaries conduct their duties which are regulated in Article 67 of law No. 30 Tahun 2004 and law No 2 of 2014 about Notary position. Based on the regulation in article 70 (a) abaut Regional Supervisory Council Mentions that this council is authorized to hold a meeting to investigate if there are any suspecions about of violations.Thus, based on the invesgation done by Regional Supervisory Council of the Aceh Timur Regecy, a notary named Awaludin has been decided to be sentenced for 4 (Four) years. However, Awaludin never proposed Substitute Notary to Regional Supervisory Council of Aceh Timur Regency.Besides, tehe Regional Supervisory Council needs to conside Article 13 of Law No 30 Tahun 2004 with the amendment of Law No 2 Tahun 2014 about Notary. A Notary can be dishonorably discharged by Minister if he/she is sentenced by a verdict made in the court for 5 (five) years or more. The aim of this research is to define about the supervision and advising done by Regional Supervisory Council to notaries who have violated any notary regulations. Moreover, this study aims to investigate the obstacles faced by the Regional Supervisory Council in supervising and advising to later explain the efforts take to prevent the obstacles in supervising done by the Council. In addition to the efforts, thus study aims to explain the law effects and sanctions decided by the regional Supervisory Council towards notary. The type of this study is a Juridical Emprical Study which is utilizes to analyze any implement law as society attitudes related to any aspects in the society it self. The type of field research approach woulds be a Positive law Regarding Suoervisory and violations. Reseaacrh is descriptive Qualitative analysis to describe, difine ad explain and analyzing applicable Laws. There are some results found based on the study abouthow the regional Supervisory Council condoct theory duties. First, Aceh has established 3 Regional Supersiory Coucil which are Banda Aceh Council, Aceh utara Council, and Aceh Timur Council.The obstacle faced by Regional Supervisory Council insupervising and advising is the restriction in time where the council members have different schedule to conduct theirsupervision. Next, the supervision efforst conducted by council are started from the Central Council to provincial Council which later goes to regional council. The law effects arisen when the supervision and advice conduted by the council is the fact that notary is always needed by people to issue the land certificates. The Notary supervisory board must hold coaching Regularly every year with the aim of Notary no one committing a violation. Keywords: Supervision, Regional Supervision,and Notaries
